Terms of Service

1. Acceptance of Terms

By accessing or using ProvenanceVault ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ProvenanceVault provides tools for cataloging personal treasures and heirlooms, AI-assisted evaluations, a professional directory connecting users with antiques and estate professionals, and related services. The Service is provided "as is" and may be updated, modified, or discontinued at any time.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. User Content

You retain ownership of all content you upload to ProvenanceVault, including photos, descriptions, and provenance information ("User Content"). By uploading User Content, you grant ProvenanceVault a non-exclusive license to store, display, and process your content as necessary to provide the Service.

You represent that you have the right to upload any content you submit and that your content does not infringe on the rights of any third party.

5. AI Evaluations

AI evaluations are provided for informational and entertainment purposes only. They are not professional appraisals and should not be relied upon for insurance, estate planning, tax, or legal purposes. Evaluations are generated by third-party AI services and ProvenanceVault makes no warranty as to their accuracy or completeness.

By requesting an AI evaluation, you consent to your treasure's photos and descriptions being sent to third-party AI providers for processing.

6. Professional Directory

ProvenanceVault provides a directory of antiques, auction, appraisal, and estate sale professionals. Listings in the directory do not constitute an endorsement or recommendation by ProvenanceVault. We do not verify the qualifications, credentials, or quality of work of listed professionals unless explicitly stated. Any transactions or engagements between users and professionals are solely between those parties.

7. Auction Results and Pricing Data

ProvenanceVault may display historical auction results and pricing data gathered from publicly available sources. This data is provided for research and informational purposes only. We make no guarantee of its accuracy, completeness, or timeliness. Pricing data should not be used as the sole basis for buying, selling, or insuring items.

8. Subscriptions and Payments

Paid subscriptions are billed through Stripe. Subscription terms, pricing, and features are described on our pricing page. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis.

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is fraudulent, misleading, or infringes on intellectual property rights
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated tools to scrape or extract data from the Service without permission
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or entity

10. Intellectual Property

The Service, including its design, code, and branding, is the property of ProvenanceVault. You may not copy, modify, or distribute any part of the Service without written permission.

11. Limitation of Liability

To the maximum extent permitted by law, ProvenanceVault and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

ProvenanceVault is not liable for any decisions made based on AI evaluations, professional directory listings, or pricing data provided through the Service.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request export of your data prior to account deletion.

14. Changes to These Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles.
